Terms and Conditions

General

1. General

​

Throughout the Terms and Conditions: Business Analysis Upskill and its management will be referred to as "The Business" and the training participants/trainees as well as the organisations who send/nominate the participants will be referred to as "The Party".
 

a. Business Analysis Upskill reserves the right to admission, of any applicant, for the training courses.
 

b. The timings mentioned for all the online training classes are as per Melbourne, Australia time zone, unless stated otherwise.
 

c. The information shared during the training sessions is of a general nature and not specific to the particular circumstances of "The Party". Hence, "The Party" should use their own discretion when implementing/acting on any information or general advice that was provided during the training session.
 

d. For classroom-based training: The training timings are generally 9 am to 5 pm (local time of the city where the training is organised) but may need to be altered at times to adjust with the requirements of the training venue. For online training classes: The training timings are generally 9:30 am to 5:30 pm Melbourne, Australia time zone, unless stated otherwise.
 

e. For classroom-based training: Meals will not be provided. However, where possible, Business Analysis Upskill will make attempts to provide tea/coffee at the training venue, at no cost to the participants.
 

f. Electronic copy of training material (slide pack, notes and any case studies/assignments/templates) will be electronically shared with the participants 2 calendar days before the first day of the training session. No hard copies (printed copies) of training material will be provided to the participants.
 

g. "The Party" shall not share (fully or partially) the training material (slide pack, notes and any case studies/assignments/templates/any other training material) with other people, nor make copies (full or partial) of the training material for other people, without the written permission of Business Analysis Upskill.
 

h. "The Party" shall not copy or reproduce any matter (fully or partially) from the training material, without the written permission of Business Analysis Upskill.
 

i. Participants are not allowed to make an audio or video recording (fully or partially) of any classroom-based training session or online training session for self playback or for sharing with/distributing to others.
 

j. All courses will be taught in English.

 

k. Content/information from IIBA's BABOK® guide has been used at Business Analysis Upskill and in the training content with permission from IIBA.
 

l. Course content/features/benefits/conditions/prerequisites and any promotion/special offers may change in future without any prior notice.
 

m. Some images on the Business Analysis Upskill website and training material have been sourced from Wix stock photos/images, Free Icons library, FAVPNG, Unsplash, Pexels, unDraw, Clker and manypixels in accordance with the respective website's usage terms and conditions.

n. Personalised support (after the completion of training):

1. Personalised support is not available for all the courses. The individual course pages mention whether personalised support is available/included in the course or not.

2. The nature and duration of the support has been outlined here and may change in future (for future courses) without any prior notice.

3. Once the training course has completed, the exact dates/times for conversations/meetings with the trainees will be worked out individually with the trainees.

4. The conversations/meetings will be done via phone calls and/or video conferencing (e.g., Zoom etc.). No physical (in-person) meetings will be done.

5. Personalised support does not guarantee/imply/entail securing a job/role for the trainees. 

6. Personalised support does not apply to Corporate bookings (unless agreed to with the company that requires training).

o. GST (Goods and Services) tax is only charged to Australian customers, as per Australian taxation laws.

​

2. Damages

 

a. In case any damages are caused by a training participant (deliberately or due to negligence) at the training venue or to the equipment and/or software used in training: "The Party" will need to bear the full cost of getting the damages repaired or affected items replaced.

​

b. "The Party" indemnifies Business Analysis Upskill management, all its trainers, contractors, casual workers and staff of any tangible or intangible damages, harm or losses at work/business resulting due to implementing/following the information, advice and ideas shared during the training sessions. The damages and losses include but are not limited to incidents such as data losses, security-related issues, reputational damages, financial losses etc.

c. Business Analysis Upskill makes all possible attempts to ensure that all the information shared during the training courses is factual and valid. However, in the instance that any information is found to be invalid or factually incorrect by "The Party", Business Analysis Upskill management and its trainers, contractors, casual workers and staff will be indemnified of any tangible or intangible damages, harm or losses at work/business resulting due to implementing/following that information.

3. Payments

​​

  • All course fee/prices quoted are in Australian dollars, unless stated otherwise or unless agreed differently with "The Party".
     

  • Course fee/price may change without any prior notice.
     

  • Any prices and payment currency agreed in writing between "The Business" and "The Party" take precedence over the course fee quoted on the Business Analysis Upskill website.
     

  • Full payment is required to block the seats. Only once the full payment is received (i.e. funds have cleared) before the course start date, the seat is confirmed for the participant(s).
     

  • Two modes of payment are accepted: Direct deposit into bank account and payment by card. Card payments and refunds are managed through our payments processor (currently Stripe).
     

  • Payment modes may change without any prior notice.
     

  • Payments processor (currently Stripe) may change without any prior notice.
     

  • At the time of booking the course, the Payments processor (currently Stripe) charge the following fees to Business Analysis Upskill: domestic cards and international cards payment processing fee, tax collection fee, invoice fee (if an invoice is sent to and paid by the course participants) and currency conversion fee (if the card payment involved a currency conversion).

    Details about these fees can be seen here. Business Analysis Upskill does not pass on these fees to the course participants at the time of making payment (when booking a course). However, in case a refund is required later on, these fees will be passed on to the course participants. Please refer to the Cancellation and Refunds section for more details.

     

  • Transaction fee/surcharge to the course participants for each of the payment modes, charged by the third parties (banks/Payment processor etc.) is listed in the following section PY1:

4. Cancellation and Refunds

​

Cancellation initiated by Business Analysis Upskill:

  • At times, Business Analysis Upskill may need to cancel the training sessions due to unavoidable circumstances. All the registered participants will be contacted/notified regarding the cancellation, before the start of the training course, at the contact details provided by them.
     

  • Refunds will be computed and processed as per the following section CR1:
     

Section CR1:
 

Cancellation initiated* before the commencement of the training

Refund amount: Full training course fee (and GST)
 

Refund processing timelines: Refund initiated within 5 business days. Refund processing timelines depend on timelines imposed by third parties (example banks, our Payments processor - currently Stripe etc.)

Cancellation initiated* after the training has commenced

Refund amount: Course fee and GST proportionate to the percentage of uncompleted training**
 

Refund processing timelines: Refund initiated within 5 business days. Refund processing timelines depend on timelines imposed by third parties (example banks, our Payments processor - currently Stripe etc.) 
 

* Where possible, the participant(s) will be given an opportunity to attend the same training course on the next available date, before initiating cancellation/refunds.
** For example: If a 3-days training course is cancelled 1 day after the course commencement, then 2/3rd of the training course fee (and GST) will be refunded.

 

Cancellation (withdrawal) initiated by Training participants:

  • Participants may withdraw from the training course, prior to the commencement of the course. Refunds will be computed and processed as per sections CR2 (Online courses) and CR3 (Classroom-based courses).
     

  • Participants who wish to withdraw from the course, will need to do so in writing, by sending an email to info@BusinessAnalysisUpskill.com.au
     

A. Online courses (Section CR2)
 

Cancellation/Withdrawal notice* 1 day or more before the Training course start date

Refund amount: Full training course fee and GST.

Refund processing timelines: Refund initiated within 5 business days. Refund processing timelines depend on timelines imposed by third parties (example banks, Payments processor - currently Stripe etc.)

 

Cancellation/Withdrawal notice* on or after the first day of training course:

 

Refund amount: No refund given.

 

Refund processing timelines: Not applicable.

* Where possible, the participant(s) will be given an opportunity to attend the same training course on the next available date, before initiating cancellation/refunds.

​

B. Classroom-based courses (Section CR3)
 

Cancellation/Withdrawal notice* 16 business days or more before the Training course start date

Refund amount: Full training course fee and GST.

 

Refund processing timelines: Refund initiated within 5 business days. Refund processing timelines depend on timelines imposed by third parties (example banks, Payments processor - currently Stripe etc.)

 

Cancellation/Withdrawal notice* 15 business days or less before the Training course start date

 

Refund amount: 50% of training course fee and GST.

Refund processing timelines: Refund initiated within 5 business days. Refund processing timelines depend on timelines imposed by third parties (example banks, Payments processor - currently Stripe etc.).


Cancellation/Withdrawal notice* on or after the first day of training course

 

Refund amount: No refund given.

 

Refund processing timelines: Not applicable.
 

* Where possible, the participant(s) will be given an opportunity to attend the same training course on the next available date, before initiating cancellation/refunds.
 

Other scenarios:

  • Participants who fail to attend the training will be charged in full and no refunds will be given. Where possible, such participants will be provided an opportunity to attend the same training course on the next available date.
     

  • Business Analysis Upskill reserves the right to cancel the registration of any participant on the basis of misconduct/unacceptable behaviour or any other reasonable factors, either prior to the start of the training course or after the training course has commenced. Under such circumstances, the following clauses will apply:
     

  • Prior to the start of the training course: Full training course fee and GST will be refunded. Participant(s) will not be authorised to attend the training course.
     

  • After the training course has commenced: Refund proportionate to the percentage of uncompleted training*** will be provided. Participant(s) will be required to physically leave the training venue (in case of Classroom-based course) or signed-out (in case of Online course). *** For example: If the participant has completed 1 day out of a 3-days training course, then 2/3rd of the training course fee and GST will be refunded.
     

  • If the participant has made a duplicate payment in error, full duplicate payment and GST will be refunded.
     

  • All other scenarios will be dealt with on a case-by-case basis and reasonable attempts will be made to achieve a mutually acceptable outcome.
     

  • Course fee/price (full or partial) and GST will not be refunded in case the participants (individual or group) are dissatisfied with the training course.

5. Change of Dates and Change of Venue

​

a. At times, Business Analysis Upskill may need to change the training dates (for online or classroom-based training) or training venues (only for classroom-based training) due to unavoidable circumstances. All the registered participants will be contacted/notified regarding the change of dates and/or change of venue, before the start of the training course, at the contact details provided by them.
 

b. In case of change of dates: Participant(s) may ask for refund due to the change of dates, by sending an email to info@BusinessAnalysisUpskill.com.au. Where possible, the participant(s) will be given an option to attend the same training course on the next available date in future, instead of initiating refund. In case the participant chooses the option of refund, the computation shown in section CR1 will apply.
 

c. In case of change of venue: Participant(s) may ask for refund due to the change of venue, by sending an email to info@BusinessAnalysisUpskill.com.au. Where possible, the participant(s) will be given an option to attend the same training course on the next available date in future, instead of initiating refund. In case the participant chooses the option of refund, the computation shown in section CR1 will apply.

 

6. Discounts

​

Group discounts:

a. Commercial organisations (i.e. For-profit organisations) that nominate group of participants for training sessions are eligible for group discounts as outlined in the following section DC1.

 

b1. Not-for-profit organisations that nominate group of participants for training sessions are eligible for group discounts as outlined in section DC1.

 

b2. Not-for-profit organisations may be asked to produce their Not-for-profit registration certificate prior to registering the participants for training.

 

c. Registration discount quoted in section DC1 is given on the course fee. For credit card payments and any refunds, the surcharge/transaction fee outlined in sections PY1, CR1, CR2 and CR3 apply.

 

d. Group discounts cannot be used in conjunction with referrals and other discounts, vouchers or promotional offers (including but not limited to Individual discounts).

 

e. Registration/group discounts/vouchers/promotional offers are non-transferable i.e. cannot be transferred to any other individual or group.

Section DC1

 

Group Discounts:
 

For Commercial (For-profit) organisations

Registration Discount (up to 4 participants): 5% of course fee

 

Registration Discount (5 or more participants): 7% of course fee

 

For Not-for-profit organisations

 

Registration Discount (up to 4 participants): 7% of course fee

 

Registration Discount (5 or more participants): 9% of course fee

​

Individual Discounts:

​

f. Individuals who register independently for training sessions (i.e. they are not nominated in a group by any organisation) do not qualify for a discount on the first course they attend.
 

g. Once an individual participant has attended a training course, a flat 20% course fee/registration discount is available to be used on all subsequent training sessions.
 

h. Registration discounts/vouchers/promotional offers are non-transferable i.e. cannot be transferred to any other individual/group.

 

i. Registration discount of 20% is given on the course fee. For credit card payments and any refunds, the surcharge/transaction fee outlined in sections PY1, CR1, CR2 and CR3 apply.

j. Individual discounts cannot be used in conjunction with any other discounts, vouchers or promotional offers (including but not limited to Group discounts).

7. Referrals

 

a. Referral award is given to referrers when they refer a friend or colleague/partner to any training course, as outlined in the following section RF1.
 

b. Referral award is given to the referrer within 5 business days after the participant completes the last day of the training.
 

c. Referral award is not given under the following circumstances:
 

1) if the training gets cancelled.

2) if the participant withdraws from the training before the course commences.

3) if the participant claims a refund by withdrawing after the course has commenced.

4) if the participants mention that the referrer had not referred them.

5) when Business Analysis Upskill management deems the referral to be unreasonable, incorrect or fraudulent.

d. The referrer needs to refer the person(s) to Business Analysis Upskill in writing, by sending an email to info@BusinessAnalysisUpskill.com.au, before the referred person(s) register(s) for the training course.
 

e. Business Analysis Upskill management may ask the participants for the referrer's name and details, when they register for the course.

Section RF1:
 

When course fee + GST (minus any discounts) is less than $400

Referral award: $50 per person

 

When course fee + GST (minus any discounts) is more than $400

Referral award: $100 per person
